Sometimes, yes. The person selling must have legal authority, and the required approvals depend on the estate. You can begin discussing pricing and preparation while your attorney and title company establish the path to closing.
MKAT Group handles the real estate strategy. Your attorney determines legal authority; your title company confirms what is needed to convey title. See legal sources ↓
YOUR JOURNEY
Discuss the property, your goals, who is involved and whether an estate attorney is already helping. You do not need every answer to make the first call.
Your attorney and title company review ownership, authority and any court requirements. Share relevant estate documents through their secure channels.
Review comparable homes, condition and carrying costs with Katie. Compare an as-is approach with targeted preparation before spending money.
Agree on access, belongings, property presentation and communications. Marketing and timing should fit the home and confirmed authority.
Consider price, contingencies and timing together. Coordinate title, any necessary approvals and signing; proceeds are handled according to the estate’s legal requirements.
FIVE COMMUNITIES. LOCAL CONTEXT.
A probate filing county and a property’s county are separate questions. For a Texas resident, probate venue generally starts with the deceased person’s domicile or fixed residence. Ask your attorney to confirm the correct court.
The Katy area spans Harris, Fort Bend and Waller counties. Check the actual property record instead of relying on the ZIP code. Price against relevant neighborhood comparables.
Fulshear is in Fort Bend County. Review the home’s condition, applicable HOA documents and competing listings when planning its market position.
Richmond is in Fort Bend County. A Richmond mailing address can cover different neighborhoods; verify jurisdiction and property-specific tax and HOA obligations.
Cypress is in Harris County. Evaluate the specific subdivision and home characteristics, then confirm estate filings through the appropriate county resources.
Brookshire is in Waller County. Confirm the parcel and any acreage, access, utility or restriction questions before setting a preparation and pricing plan.
COMMON QUESTIONS
General education for inherited home sellers. Your estate may need a different approach.
Text Katie your question ↗Sometimes. The estate does not always need to be closed before a sale, but the seller must have legal authority. The will, administration type, court orders and title requirements determine the route. Have your probate attorney and title company confirm authority before committing to a closing.
No single route fits every property. Ownership documents and estate circumstances may allow a different transfer process. An attorney should identify the proper procedure; a real estate agent cannot decide legal heirship or clear title.
For a Texas resident, venue generally begins with the county of the deceased person’s domicile or fixed residence, not simply the home’s ZIP code. Other rules apply in some circumstances. Katy spans Harris, Fort Bend and Waller counties; Fulshear and Richmond are in Fort Bend, Cypress is in Harris, and Brookshire is in Waller. Confirm the correct venue with an attorney.
A sale can create taxable gain. Inherited property generally receives a basis tied to fair market value at death, subject to exceptions such as a valid alternate valuation election. The current list price and county tax appraisal are not automatically that basis. Ask a CPA how to document value and report the sale.
Compare likely sale proceeds, repair costs, time and ongoing expenses before deciding. An as-is sale can reduce preparation work, but buyers may still request inspections or negotiate. Katie can help compare property-specific selling strategies.
Pause major sale commitments and ask the estate attorney who has decision-making and signing authority. Beneficiaries and legal sellers are not always the same people. MKAT Group can provide market information, but does not resolve legal disputes.
These obligations do not simply disappear when an owner dies. Ask the estate representative and attorney how payments should be handled, and contact the insurer about occupancy or vacancy. Keep records of expenses and avoid assuming a family member will be reimbursed.
There is no reliable universal timeline. Legal authority, title issues, property condition, buyer financing and any required court approval affect the schedule. Build a property-specific plan before choosing a target closing date.
